This Biometric Data Privacy Statement governs the collection and processing of Biometric Data in connection with the services ("Services") provided by Larkin Mortuary, Larkin Memorial, Rocky Mountain Vault, and Utah Simple Creations (collectively "Larkin," "we" or "our"). This Biometric Data Privacy Statement is part of and a supplement to Larkin's Privacy Policy, and is incorporated into Larkin's Privacy Policy by this reference.
Under Utah law, biometric data ("Biometric Data") is data generated by automatic measurements of an individual's unique biological characteristics, including an individual's fingerprint, voiceprint, eye retinas, irises, or any other unique biological pattern or characteristic that is used to identify a specific individual. It does not include a physical or digital photograph, a video or audio recording, data generated from a photograph or recording, information captured from a patient in a health care setting, or information collected, used or stored for treatment, payment, or health care operations.

Biometric Data we collect will vary depending on the way in which Biometric Data is defined by each jurisdiction, the purpose for which it is collected and the type of Services you request.
We may collect the following Biometric Data:
We do not generate data based on automatic measurements of an individual's unique biological characteristics based on images we collect, and as such, the images we collect are not Biometric Data under Utah law. However, to the extent these images may constitute Biometric Data in other jurisdictions, this section applies.
o We may require you to provide or upload an image of the Decedent using your computer, mobile, or other device. We collect, process, use, and/or store these images for purposes of verifying the Decedent's identity. We may also collect, process, use, and/or store these images to create obituaries, memorials, memorial products, or similar Services you may request.
We may collect, process, use, and/or store fingerprint information of the Decedent for purposes of verifying the Decedent's identity. We may also collect, process, use, and/or store fingerprints to create obituaries, memorials, memorial products, or similar Services you may request.
Larkin may use the Decedent's Biometric Data to verify the Decedent's identity, and/or to create obituaries, memorials, memorial products, or similar Services you may request, for other purposes as specified, and to comply with legal obligations or comply with a request from law enforcement or government entities where not prohibited by law.
Larkin will only share the Decedent's Biometric Data as follows:
o With third parties when permitted or required by law to enforce our agreements, to comply with legal obligations, or to cooperate with law enforcement agencies concerning conduct or activity that we reasonably believe may violate federal, state, or local law when required by a subpoena, warrant, or other court ordered legal action, and to prevent harm, loss or injury to others.
o With third party service providers and vendors that perform functions on our behalf, including providing memorial products. These service providers and vendors are limited to using the Biometric Data to assist in our provision of Services, and must maintain any Biometric Data we share in a secure fashion. When Biometric Data is disclosed to a third party service provider or vendor, their collection, processing, use, storage, and disclosure are governed by the third-party's own Privacy Policy, and you should consult the Privacy Policy of each third-party.
o Other disclosures to which the Decedent has consented, or to which the user or representative consents.
Larkin will not sell, rent, or trade your Biometric Data. Your Biometric Data will only be used by Larkin for the purposes specified herein.
Larkin may retain photographs used for identification purposes and/or fingerprints used for identification purposes and memorial products in accordance with applicable law until the occurrence of the first of the following: (a) the initial purpose for collecting or obtaining such Biometric Data has been satisfied; (b) up to four (4) years following your last interaction with Larkin, unless a shorter retention period is required pursuant to applicable law or contract; or (c) as long as necessary to confirm identification, which Larkin may determine in its sole discretion.
Additionally, Larkin utilizes third-parties (each a "Memorial Party") to provide memorial services, which includes the Memorial Party collecting, processing, using, and/or storing fingerprints for memorial products. The Memorial Party's collection, processing, use, and/or storage of fingerprints is governed by the Memorial Party's Privacy Policy, available at https://legacytouch.com/pages/privacy-policy.
Larkin also reserves the right to retain de-identified or aggregated biometric metadata for system integrity, compliance, and improvement purposes unless prohibited by applicable law.
If the Decedent's identity has been successfully verified, if the service has been completed, and if there is no longer any need for Larkin to retain the Biometric Data, you may request that Larkin delete the fingerprints and/or photos of the Decedent by submitting a request to tech@larkinmortuary.com. A response and/or deletion of the images and Biometric Data may take up to seven (7) days. Larkin reserves the right to retain the Biometric Data as needed to comply with our legal obligations, including warrants, subpoenas or other court orders, to defend itself in legal proceedings or threatened/potential proceedings, and or identification purposes.
If you wish to delete fingerprints held by the Memorial Party which were gathered for memorial purposes, you must contact the Memorial Party by phone (855) 802-6800 or email info@legacytouch.com.
Larkin employs physical, technical, and administrative procedures to safeguard the Biometric Data it collects. However, Larkin cannot fully ensure or warrant the security of any Biometric Data it collects or which you provide. By using our Services and/or Websites, you acknowledge that there are data security and privacy limitations inherent to the use of the internet, and that the security, integrity, and privacy of any and all information exchanges between you and Larkin, or between you and other related entities, cannot be guaranteed. We cannot ensure or warrant the security of any Biometric Data we collect, process, use, disclose, or store, and you do so at your own risk. By using our Services and/or Websites, you hereby consent to our Privacy Policy, including the Biometric Data Security Policy, and agree to their terms.
This Biometric Data Privacy Policy may be periodically updated. From time-to-time we may update this policy to reflect new features or changes in our privacy practices or our Services.
