1. Acceptance of Terms
By using the website www.larkinmortuary.com (the "Website") or engaging the services of Larkin Mortuary ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Website or our services.
2. Services
We provide funeral and cremation services as described on the Website. These services may include, but are not limited to:
- Traditional funerals
- Cremation services
- Memorial services
- Pre-need arrangements (arrangements made in advance of need)
3. Payment
- We process payments for both Larkin Mortuary and Utah Simple Cremations. The following payment policies apply to both corporations.
- All payments for services are due as outlined in our agreement with you.
- We accept the following payment methods: credit cards, check, and US bank account transfer (ACH). We do not accept debit cards.
- All online payments via www.larkinmortuary.com are processed securely via Stripe (www.stripe.com).
- Any payment with credit card will incur a processing fee up to 3% of the total charge. It may be less depending on the current fee rate charged by the payment processor. Please note that processing fees are non-refundable.
- Insurance assignments will be accepted as partial or full payment of the funeral bill. The insurance must be verified prior to acceptance of the assignment. The policy must be fully assignable to the funeral home and cannot be contestable. All such verification must be completed prior to services.
- In cases where the deceased's estate must stand the burden of paying the funeral expenses, we ask that family representatives pay the funeral expenses and file claim for reimbursement with the deceased estate.
- Recurring Payments: When a customer opts into a recurring payment plan for prearranged services, they authorize Larkin Mortuary to charge their chosen payment method each month for the specified amount on the specified day on the payment contract. Customers may modify or cancel their recurring payment plan at any time by contacting Larkin Mortuary directly.
- Declined Payments: In the event a payment is declined, Larkin Mortuary will attempt to re-process the payment within 2 business days. If the payment continues to be declined, we will contact you to update your payment information.
- Payment Disputes: If you have any questions or concerns about a payment, please contact us immediately so we can resolve the issue promptly. We reserve the right to counter any disputes from a customer's credit card provider/bank with contract, payment, and receipt evidence.
- Arbitration: Any legal dispute arising from a payment made shall be settled through binding arbitration with Larkin Mortuary in accordance with the laws of the State of Utah.
4. Intellectual Property
All content on the Website, including text, graphics, logos, images, and software, is the property of Larkin Mortuary or its licensors and is protected by copyright and other intellectual property laws.
5. Limitation of Liability
- We strive to provide accurate and up-to-date information on the Website and in our communications. However, we do not guarantee the accuracy, completeness, or reliability of any information.
- We shall not be liable for any damages arising from the use of the Website or our services.
6. Modifications to Terms and Conditions
We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the Website. Your continued use of the Website or our services after any modifications constitutes your acceptance of the revised terms.
7. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Utah.
