Analytics/Log File Data, which logs visitors to the Websites. The information inside the log files includes, but is not limited to, internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date/time stamp, referring/exit pages, and possibly the number of clicks. Where required under applicable laws, we will obtain your explicit consent to process your sensitive data, unless the processing is required for reasons of substantial public interest.

This section specifically addresses the collection, use, and sharing of data related to our SMS/MMS messaging campaigns. Standard message and data rates may apply to messages sent and received as part of our SMS/MMS program.
Collection of Information: When you opt-in to receive SMS/MMS messages from us, we collect your mobile phone number and any information you provide in your messages to us. This may include your name, contact preferences, and other relevant details depending on the nature of our communication. We also collect data related to your interaction with our messages, such as delivery status, open rates, and click-through rates.
The information collected through our SMS/MMS campaigns is used solely for the purpose of sending you messages related to funeral service updates, pre-need planning information, and grief support resources. This may include appointment reminders, service announcements, informational updates, and other communications you have consented to receive. We will not use your mobile number for any other purpose without your explicit consent.
We do not share, sell, rent, or trade your Personal Information, including your mobile phone number, with third parties for their marketing purposes. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. We may share your information with trusted third-party service providers, such as Twilio, who assist us in operating our SMS/MMS messaging services. These providers are contractually obligated to protect your information and use it only for the purposes for which we disclose it to them.
Opt-Out/Unsubscribe: You can opt out of receiving SMS/MMS messages from us at any time. To unsubscribe, simply reply **STOP** to any message you receive from us. You will receive a confirmation message that you have been unsubscribed. After this, you will no longer receive SMS/MMS messages from that specific number. Data Security for SMS/MMS: We implement reasonable security measures to protect the confidentiality and integrity of your Personal Information collected through our SMS/MMS campaigns. However, no method of transmission over the Internet or electronic storage is 100% secure.
Larkin's Websites are not directed to children under the age of 13, and Larkin does not knowingly collect Personal Data online from children under the age of 13. If you are under 13, do not attempt to register for or use our Websites, and do not provide us any Personal Information about you. Larkin does not intend to collect the Personal Information as defined under the Children's Online Privacy Protection Act ("COPPA") of anyone under 13 via this Websites or any of our other online services in any way not allowed by COPPA.

(d) investigate, establish, exercise, prepare for, or defend a legal claim;
(e) provide a product or service requested by a consumer or a parent or legal guardian of a child;
(f) perform a contract to which the consumer or the parent or legal guardian of a child is a party, including fulfilling the terms of a written warranty or taking steps at the request of the consumer or parent or legal guardian before entering into the contract with the consumer;
(g) take immediate steps to protect an interest that is essential for the life or physical safety of the consumer or of another individual;
(h) (i) detect, prevent, protect against, or respond to a security incident, identity theft, fraud, harassment, malicious or deceptive activity, or any illegal activity; or (ii) investigate, report, or prosecute a person responsible for an action described in Utah Code Ann. 13-301-64 (1)(h)(i); (i) preserve the integrity or security of systems; or (ii) investigate, report, or prosecute a person responsible for harming or threatening the integrity or security of systems, as applicable;
(j) if the controller discloses the processing in a notice described in Section 13-61-302, engage in or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws;
(k) assist another person with an obligation described in this subsection;
(l) process personal data to: (i) conduct internal analytics or other research to develop, improve, or repair a controller's or processor's product, service, or technology; (ii) identify and repair technical errors that impair existing or intended functionality; or (iii) effectuate a product recall;
(m) process personal data to perform an internal operation that is:(i) reasonably aligned with the consumer's expectations based on the consumer's existing relationship with the controller; or (ii) otherwise compatible with processing to aid the controller or processor in providing a product or service specifically requested by a consumer or a parent or legal guardian of a child or the performance of a contract to which the consumer or a parent or legal guardian of a child is a party; or
(n) retain a consumer's email address to comply with the consumer's request to exercise a right.

Right to Access/Disclosure. You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt.
